What would YOU do?

Almost exactly three weeks ago, my young embroidery machine bound up beyond my ability to repair, and that was the end of my stitching with that. I had been making a few items for a local fund raiser bazaar. I immediately took my machine in for service. I begged them to try to fix it in store because I was in the middle of a project, and also wanted to get some gifts made for Christmas. They said to wait a week.
I've been calling the store regularly, and each time, I get a different story as to why it is not there. Today they came clean. They lost it. Embroidery machine, module, all peripheries. This was a Duetta 4500. Gone. Other than cry and feel lost, what would YOU do about the situation? Getting mad won't help because that won't bring the machine back. :( I would love some suggestions from the embroidery world.

NEWS! NEWS! NEWS!
I just got a call about my machine. For some reason, someone who wasn't paying attention, put my machine and all of the pieces in their storage unit; the unit they use for trade-ins. There it sat for over 3 weeks. They are working on it, and will have it ready to go tomorrow! And for the upset and hassle, they will be gifting me a pack of scissors. I'm happy that they found it, and it will be coming home again!! Thank you for your support and kind words!!!!

Good news! They should be fixing it for free because of such a mishap and the fact that they won't have to replace it. ( Which is what I would have held out for.)

Great news ! I agree with jofrog ; they should fix it for free AND I know I wouldn't be happy with just a pair of sissors as compensation of all the horror you went through

absolutely agree with the free fix - at the very least. If they lost it they should have replaced it and that would definitely cost more than a repair. So, don't settle for just scissors - make sure you get your machine back in perfect working condition (try to see if you can try it out at the shop before you leave) and the demand that they comp you the cost of the repair.

I feel so bad for you. I grew into my duetta so I still have back up, but oh it is hard to be with out it even for a day. I believe you are due for an upgrade and this may be a good thing in disguise, I hope so and I hope you are stitching very soon indeed!

Speak with the owner. Report them to the maker of the machine and if the owner does not work quickly to resolve it -- report them to the Better Business Bureau as well as the police. Don't wait any longer to take action. You are right, getting mad probably won't help but swift legal action will. They only have so much time with the BBB to resolve the situation. Unless they offer and make good on the offer to make everything better...talk to an attorney to see what your rights are in this case.

Very strange attitude on the part of the dealer. Do they expect you to just accept it is lost and go away? They should be bending over backwards to make it right.

This is a horrendous situation. Ask them for their insurance agency/carrier information and call and file a claim under whatever bailiff liability coverage they have. They absolutely owe you a like kind and quality machine...if not a better one for your loss of use. In the mean time ask them to give you one one to use until the problem is resovled, it's the very least they can do for you. Good luck to you! ~Rita

If it were mine I would go to the store and ask for the oner and I would nicely tell him to either find my machine or pay me for it or replace it with a new one or I would call brothers if the guy is a brothers dealer and tell them what happend and demand a replacemont for it.
.that is what I did when I could not get mine fixed they kept telling me for months they were waiting on a part I called brothers and with in a week I had a new mwchine mine is a duetta 4500.

Sorry to hear about your problem, the store should be insured and they should replace the lost machine. I see a long road of difficulty ahead for you, hope it works out, being without a machine is the pits

It is the stores responsibility to make this right for you. They can either "find" it or replace it.

Don't give up till you have a resolution. I can not imagine a shop being so big it would take more than a couple of hours to locate it. Does sound odd they don't have their paperwork. They made their biggest mistake by trying to hide it--makes them look guilty and/or totally incompetent. Brother should diffently be told about this dealer

They use a string to tie the tag on to the machine and give the claim ticket to the customer. The whole works disappeared. I kind of wonder if the wrong customer was given my machine and failed to say anything.

Don't stop! Go to the top if need be! That is just plain irresponsible for a store to do that! My Diamond has been "in repair" for almost 2 mos & I, too, need to get projects done! What is it with these companies that they can't make a machine anymore that will last more than a few years?? THEN take forever to repair it OR lose it completely!! Keep us posted!

2 months!?? Did they tell you that it was going to be that long? I would be wondering if someone gifted themselves with a nice machine with that long wait! I hope you get yours back soon!!! I will be calling the store owner tomorrow. They are closed, or I would do it right now!

This is awful. The store must have insurance to cover something like this. You have received a lot of good advise. They should replace your machine. Keep us posted on the outcome please. I am so sorry. This is a horrible time not having a working machine.

Different states have different laws. I think you can take claims up to $10,000 to small claims courts now in some states if you need to go that route.

First report it to the police then read you slip carefully. Make sure it does not say they are not responsible. IT was in their care and they need to replace it. It is the law they have to return it to you. Check with a lawyer if they will not replace it. Any reputable store would make good on the machine,. They should carry insurance for this. Suzanne

The only slip I have is the claim ticket with the # on it. It is still under warranty and I bought it from them. But here another day has gone by with no response from them. I sure hate to cause a ruckus because I still have 3 more years of warranty that I fear losing.

OMG and my machine is at the repair shop as I write!!! First of all did you have a slip - like a receipt when you left your machine? If you did please read all the 'fine' print to know where you stand. I agree with the other Cuties that they need to replace it. Please let us know what the outcome of this terrible situation is. I have the claim ticket, but they have lost the other part of that as well. I will let you all know what happens. My son is going to help me, and plans to tighten the thumb screws today! Thank you.

Please, call the company who makes the machine to report the issue. They may be able to put added pressure on the store to make good their mistake. I am so very sorry to hear this.

I think the store is responsible for the loss of the machine and should replace it with the same type and all the accessories with it. If not I think I would consider suing the store for the damages you have incurred with the loss of the machine. They should have already offered to replace it. I hope this works out in your favor. If they can't find it, they should replace it immediately. Is there some kind of trading standars officer in your local government? They may not be able to help but could put you in touch with someone who could.

You would think that they would have contacted me to make this right but I've had to call them to point out that the machine isn't here. I suspect it was stolen at some point so that they don't even have the paperwork that accompanied it.

They have been looking for it for 3 weeks, so I have a feeling that it is gone. I have the company owner's name and contact information, and that will be my next step should this not work out. I'm in Washington State.

I agree with granniebea. The store is responsible for your machine when they take it in to work on it. I would start out nice and ask them what they are doing to try and find it. Then remind them that you are loosing income from not having your machine and if they can give you a loner of equal or better abilities to use until they find yours. Then I would go from there depending on how they treat you. It also wouldn't hurt to talk to your insurance company and see what they suggest.

I know you hate to put in a claim with your insurance company esp. when it is not your fault as that always seems to raise your rates but I think I would call my homeowners agent, tell them what happened and see if they will go after the repair shop. Sometimes they will do that to avoid having to pay the claim themselves. Seems like this would almost have to be an inside job unless the whole store has been broken into Good luck

I would suggest filing a claim with their insurance carrier first before filing with you own carrier as you don't want a claim aginst your policy...but in the event yo are forced to file a claim I would think your insurer would subrogate against the responsible party.

OMG, I do feel for you.Is it lost or stolen? I would put in a report to the police and an insurance claim to the store or your home insurance. Have they offered you compensation for the machine, I know that isn't the point but If they didn't take reasonable care of your machine they should compensate you.

No one seems to now if it is lost or stolen. It is just gone. They have my entire setup. No one has offered anything yet, but I'm going to have a chat with them today. My son has taken it upon himself to apply the pressure to make sure they make it right They are the ones who sold it to me, and it went in for service under warranty.
