I recently purchased 3 DVD's from Ebay, in all they contained over 150,000 'stunning' E/Designs. The seller listed these as Quote 'My own private collection.' I have been thinking about this....Err would anyone pay for this amount of designs, if so lets say they were 50p each, (unlikely but if they were, then I got a bargain at £30.00) so does this mean I may have copyright issues here, if I were to sell something with any of these designs on?

My first purchase after the machine and PED-Basic was a CD on ebay with 15,000 designs, it has designs that I know are copyrighted and also many that I have found free on line. I doubt she owned or digitized anything on the CD, I have only stitched a couple but if I want to stitch something from it I will throw caution to the wind and take my chances, lol! Chalk it up to a lesson learned and do what you want as long as it is just for your personal use. Don't sell anything with those designs.

Welcome to Cute!
We have all had some designs that are not 'ALLOWED'until we know the ropes.
I love all the freebies that I get by following all the links from the Cute Site. Now my collection has grown and I have many "legal" designs to sew out.I choose from these if it is an item I would like to sell.
I hope you get to enjoy your new machine and all the lovely designs.

So you made a mistake, you didn't know any better and if you'd never mentioned buying from ebay no one would have known. So you kind of shot yourself in the foot on that one...lol. But it's not like someone is going to come out and arrest you for your crime and you're not public enemy #1 by any means. You've got a lot to learn as to the do's and don'ts as far as designs are concerned but we all learn something new daily and if we don't we're not paying attention.

I hate to say it, but you did not get a bargain. These are more then likely illegal designs. And possibly not hers.
Have you stitched any of the designs? They may look good in the picture but how do they stitch?
A lot of sellers, especially on E-Bay sell designs that they have taken from other designers.And have written and re-written on CDs,totally destroying the designs.
These people also digitise them automatically, and do not test them, churning out hundreds of bad quality designs which they then try to flog on E-Bay.
I am sorry, but it seems like you got a very bad deal.
I suggest, keep away from E-Bay and buy your designs from reputable sites.
The old adage- if it sounds too good to be true it most probably is!

Yes. You are probably right. I now consider myself 'told off.'



A mistake that is easily made when one is new to any hobby. Having purchased I was eagar to obtain designs and start learning about my new toy. Having no knowledge of how or where to obtain these, I looked to EBay.



Sadly as stated in my profile, my beautiful daughter was nearly killed in a horse riding accident, so I was delaid in useing both the machine and the designs. However, I have now stitched some of them and they do stitch beautifully, but there is no way I could begin to test them all. I am not worried about the money, but I am concerned that they may not be above board.

Given the 'old adage' not knowing anything about the value of designs, I did not have a clue at the time, as to whether it was a bargain or not. The lady sent me a few samples, they stitched well, I was happy with the price and so whoola...Of course, I know better now.

This is a good point, if their are no terms and condition or copyright information on the disc then you probably have something illegal.

Well she also has a website, but given what I have been saying here I am reluctant to add the link. The website makes no mention of her creating the designs. Just selling the DVD/CD's and she neither mentions copyright, the only thing she states is that I cannot copy the disc and sell it. But you would, wouldn't you... Hmmmm.

Errr...hmmmmm I am reluctant to put it up here, given libality laws. I have just come from EBay and she is not listing them at the moment. I also notice that all the listings are under 'private listing'. I have been into her website and she makes no mention of copyright AT ALL...nor does she state these are her own designs. At the same time she neither says she is a digitizer.

That is a hard one to answer but I would think it impossible for one digitizer to do that many designs and do them well, testing perfecting etc... I would definitely be suspicious. I just worked it out, I get about 200 per year that are good enough to put on my website. in 20 years I would only have 4000 designs. Of course I do other things and don't spend my whole day digitizing and testing but just the same I can't imagine anyone producing that many designs and it being their own "private collection".

I agree with you. No way could she have done this, infact I am sure she did not. I have just come from the listing and it states...'Alldesigns from my own private collection.' So one assumes she has collected these. If so, thewn ofcourse there would be copyright attached. I did not realise any of this prior to buying them. Guess I am stuffed!

I am not sure but you may be able to contact ebay. if they are aware that someone is selling something that is a copyright infringement they may be able to help you get a refund. Of course it may be polite to contact the seller first. I will ask my husband he is way more familiar with ebay that I am.

Another thought. if you paid with paypal you may have some luck with a refund there. I have a merchant account and I got an email a couple of months ago saying that they had changed there policies to protect the buyers more. I think you could say the goods were not as described or some such thing.

I have a cd set and it actually says I have permission to use the designs for my own commercial and personal embroidery. Is a disclaimer on your set. if you got 150,000 it would make me wonder. We all have our own private collection, but the designs that make up mine are purchased and i don't own the copyrights. I'm interested in seeing what someone with more knowledge than myself has to say

No. I merely have the disc's with just the designs on them. Nothing else. The seller is still selling them. I also paid £10.99 for a DVD/CD with 50 different 'alphabets,' from the same seller. These two are truly stunning. I am very concerned now.
