Was offline for 2 days. Tried to show a friend (a non embroiderer) why I am so passionate about this hobby and then realised the designs have dissappeared. Luckily have now seen why. Thank you for the link below. Will look into the pricing and rather buy them. Although also new to this site I must say it was always my understanding that the designs by cuties meant digitized by you yourself and shared with this talent with the rest of the cuties, although in the beginning I also thought it meant you should also have done the graphics. Thanks for the advise below.

Okay we will wait and see like Marjia suggested.perhaps it's all a misunderstanding.

Little update: Veronika has closed all the posts from this person until she gets a satisfactory answer about the artwork, etc. Apparently there's a little language problem, not uncommon with all of us speaking different languages. If they're ok, different digitizer using same clipart, they'll probably be back up. If not, you'll probably be asked to erase them. But DON'T do that yet, till this gets resolved, ok? It's being worked on, just kind of put it on hold for the time being. Thanks for your vigilance and patience, hope this works out best for everybody. Big hugs, Marji

I did put a message for Ruzik on her upload, advising her that it is illegal to post designs copied from another digitiser as it breaches International Copyright laws.

I think some New members may think it is all right to share designs, because they just don't know the rules.
Hugs n blessings, Meg

Acepoint states their rules explicitly:
When you purchase designs at pointsof.com, you are the sole "authorized user" of the software and are legally bound by the copyright laws that apply to this authorization. By downloading the files, you are agreeing to adhere to these guidelines. You are actually buying a license to use the software files to stitch out on items for gifts, personal use and limited items to sell. The original software remain the sole property of the original artist who holds the copyrights, digitized files and permissions for the artwork. You are prohibited from sharing, transferring or selling the design files by any means. You are also prohibited from altering, combining or changing the files except to customize a design for personal use only. This policy is strictly enforced and breach of this agreement could result in legal action.

Why don't people read and stick to the rules?? It's so stupid not to.

I haven't seen it asked, so I will ask, "How do you know they are Acepoint designs?" Many digitizers purchase the same clip art. Acepoint does not claim that these girls are exclusively theirs. Do you have some proof or is it just that they look the same?

Possibly the fact that they are only available in one format and that she has noted "Original Artwork" in the section calling for Artwork licence.

Obviously the artwork is not Original.
These are only "presumed" on my part.

And that the photo looks exactly like a contact print from a CD cover, or a JPG download of specs for a design set. Or that a whole set is included in one posting, instead of individual postings like everyone else does for alphabet letters, etc.

When you see enough professionally done designs, you can spot them. If the digitizer is a professional, why no information at all in the profile, wouldn't she at least be advertising such excellent work? I'm "presuming" like Meganne is. For 'fishy' I give the benefit of the doubt. For 'really really fishy', especially when someone's identified it from another site, well....

mpo14011 by mpo14011 18 Oct 2009

And if this person was really the digitizer, he/she would have acknowledged the Artwork,as should be done on ALL websites.

auntie by auntie 19 Oct 2009

Thanks, Ladies! I didn't d/l them or look very close at the sheet that was posted. I was wondering if it had "Acepoint" somewhere on it. As for the Original Artwork being blank, I thought it could have been an oversight or maybe she needed to find it to add later, (since she was new to posting design) she might not have realized she needed the artist name. Hope it gets straighted out, either way!!

You know - when I saw that set - I thought I had seen them before - but you just never know about clip art and who has bought what. I saw the post from Veronika and that said a bunch to me - so I just left a * and left the designs alone. *4U

Thanks so much for this post and the warning to the Cuties. Cuties, please please if you see something like this in the future, tell Veronika right away so she can delete it!!! It doesn't matter if it was a mistake or done on purpose, Ace Points is going to be really angry about it, and can certainly make a lot of trouble for this site if they choose. These things must be removed, as well as warning people here in the community, because a lot of people who download don't even come to the community, and don't read the other comments under the design, either. I am so disappointed to see this happening here, and really afraid we're going to lose this community if it isn't stopped. Between this and the design sharing "Cute Embroidery fanclub" on Facebook, this is a disaster. Thanks for the warning, Edith, I'm glad you could identify the designs. Hugs, Marji

Veronika did make a post - asking for the orignial art work on this.

auntie by auntie 17 Oct 2009

I also noticed the question from Veronika, but she has since removed it. I am curious if you think she deemed the designs to be illegal would she have removed the question but not the designs?

meganne by meganne 17 Oct 2009

the question has not been removed it is on page two. HNR, M

auntie by auntie 17 Oct 2009

Thanks Meganne, I did look on page 2 before I posted. I missed it. You are correct, it is still there!

If everyone downloaded these that gave a flower, (164 at $20/each) that's $3,280 that was given away.

Do you know from whom the designs originally are? I saw some designs on so many emboiderypages (especially sunbonnets and ragdolls). Maybe it is my imperfection never to think bad about unknown people :o)

clueless by clueless 17 Oct 2009

they are ace points u are like me i am new to this embroidery and have found many copyright things

I was wondering about the girls because I have the baby boys from Ace Points but I thought that this were pictures from clipartopolis or another supplier so more than just one person has the rights for the designs (if they aren't exclusive designs). On Oregon Patch (where I bought the boys) this girls are not listet in the index of Ace Points.

Here in Germany we have at the moment a great wave of reminders against people selling on DaWanda (simular to etsy): a company for outdoorclothes with a wolfpaw-logo admonish people having any kind of paw on they work; in one case it was a fabric of michael miller with paws! Absolut crazy...

Wow. I noticed the feathers are gone and the girls are still there. Also some comments have dissapeared like mine helping people how to download the designs. Now I feel aweful. I also noticed that Miss Veronika had asked about the designer. How can we protect ourselves and Veronika from all this?

does cute not have a moderator that watches for this kind of stuff happening?

A moderator would need to be familiar with every design by every designer to catch something like this, unfortunately. I thought they looked like professional pages, and asked about the artwork and permission to use it. But I don't know Ace Points catalog, so I didn't recognize them as stolen. What a nuisance these folks are!
