I have an ethical question: If I bought a cd of a set of designs, and opened the case and looked at the designs on my computer, but never saved or sewed the designs, is it ok to pass it on to someone else? Or is this a violation of copyright somehow? I caught the "ooh its on sale so I must buy it" bug and bought some things that now I don't really care for.

The designers have the idea and produce the TOOL for us to make items and sell them. If I made paintings with a new style of paintbrush, that doesn't mean I can't sell those paintings or sell or give the paintbrush away if I don't like or use it. It beggars belief that producers of wooden and rubber stamping blocks (a TOOL) can say ' not to be used on products for re-sale' COPYING the design and claiming it as your own is what's wrong, but don't sell us TOOLS and tell us we can't use them. well, I finally got that unwanted cd out and read the copyright. It says it is licensed for use by original purchaser only. So, I won't be passing it along. Thanks for all your answers and insight.

I think you should contact the digitizer, if possible, by Email and confirm what happened. It would then be up to them to say yes or no to such a situation. I hope you can get it right without infringing the policy, and the income of the digitizer.****

If the person who purchased the designs has never used them or saved them on their computer, I would think to give them the CD leaving yourself with nothing would not constitute "sharing". You have never used the designs or saved them. This would be like buying the CD and giving it as a gift. My definition of "sharing" is when you have purchased a design, keep it, and also pass it along to give it to someone else. That is certainly stealing because the person you gave it to has not paid the digitizer for the design.

Wow. I never gave it a though if I pass on I can't legally pass on my sewing room and all it's contents to my dtrs. or granddtrs. I paid a lot of money for my designs, machines, fabric etc. and feel I own them. I would never consider passing them on and keeping copies for myself. I see where that could be an infringement...but when I passs on...really? I'm not planning on going anywhere for a llloooonnnngggg time. Hehehe :) Am I wrong?

When I first got my machine I bought a CD off ebay, not knowing anything about anything at that time I didn't get any stitched out, but after reading posts on here I soon found that most of what I looked at on the CD was copyright designs that the person had downloaded onto the CD themselves after probably getting the designs illegally elsewhere so that was money down the drain. Because of cute I learned about that, had I not found cute I probably would have used the designs without ever knowing I was breaking the law. There were Disney designs and designs I have seen on legal sites.

You paid for the cd-it belongs to you-why on earth would you not be able to give it to someone else??? My goodness-people sell collections on E-bay... It's not as though you are stealing designs and selling them right?

Reading a statement like this makes me wonder why we ever bother to put a copyright regulation in with the files!
Only because you see collections on ebay, does not make them legal.
In fact, there are a lot of illegal design collections on ebay, amongst other things.
Like I said before, you only pay for the right to use the designs. They will ALWAYS belong to the digitiser.
And yes, you are stealing designs. And you are also stealing the income derived from these designs.
So in essence you are stealing two fold.

As I said before, the designs will ALWAYS remain the property of the digitiser.You are only paying for the right to use them.

I don't want to start another WW right here on cute but I have to say Ricky-I hope I am misunderstanding this-when I die or give up sewing-my entire "sewing room" goes to my daughters. So now, because I am the one that has bought designs and collected them-even though I am dead or whatever-my daughters can't use an of the designs??? PSYUHH-

good question. I looked at a set I have and it says"Permission denied to resell or give away machine embroidery designs in electronic format including this cd". I do not like these designs so I guess they will go back into the drawer.

I understand that it's a violation of copyright. The designs themseves always belong to the digitizer and the person who buys them is the only one allowed to stitch them. If you buy a CD in a sealed package from a shop and don't open the package at all, may be in this case you can give it to somebody else as a gift. Have you read the Legal Notice on the package? Personally, I would not give the package to anyone. If you want a friend to have the same designs, as a gift, order another CD from the digitizer and have it delivered to you friend's home address. Peace of mind is essential for you and for your friend. Hugs, Lidia

I think you can give it to someone. They should be advised of the terms of use that accompanies the designs. I think it would be the same as buying a CD of designs as a birthday gift for someone.

You will need permission from the digitiser if you wish to gift the CD to someone.
They may do 1 of 2 things; say yes to your request, or get the details of the recipient from you so they can send it to him/her.
Otherwise it could be construed as sharing.

Did you read the copyright regulations that should have been included with the file?
The designs will always remain the property of the digitiser even if you have bought them. You have, in fact, only bought the rights to use them.
Sharing is illegal. If you give this CD to someone else, you will be in breach of copyright regulation.
You can, however, ask permission from the digitiser if you can give the CD away.

I think you can pass it to someone else.....

It is up to you once you bought the cd, you are the owner of the designs and you are free to do......

No law has been made to denied any owner from sharing its own things......
