Lr2008, I would tell Vermillion that someone is stealing their work & giving it away, and give them the site where you found it. Let them go after the pirates. Vermillion has beautiful stuff, thank for directing us there. Those Fantasy Bears are very very different, never seen anything like them!

Oh, lr, also, I was not suggesting you pass on designs, most of us know that's wrong. But there have been questions here from people that apparently didn't know, asking for people to send them the freebies they missed, and we've had to explain why we cant *a lot* here. oh no proble, I just get worried when people ask because I could loose my machines and I have 3 huskvarna machines, its quite an investment to loose.

The Yahoo embroidery groups have been a buzz the last few weeks with two different individuals pirating, reselling and giving away copyrighted embroidery files. Be very careful some of these sites are not only violating copyright they have passing on virus and are phishing, too. If it looks too good to be true, it probably is.

Freida, can you give us more information? Which Yahoo groups, which sites? I don't go to many other that SICK & Cute, but I don't want to accidentally get myself into a fix if I stumble on something. thanks, Marji

I don't know about you girls, but if I was *suspicious* of a designs legality, I wouldn't touch it. While it was given for free which would make me innocent, the copyright and federal bodies might not see it that way. In my book that is definitely *not* worth the risk.

I didnt realize what it was until after I downloaded it and then went searching to find out who it was by..Otherwise I would not have downloaded them..I did contact Vermillion yesterday and they told me It wa ok to keep the desings and use them but not to pass them on to anyone. The site is completely down today..wonder what is up with that..I gave Vermilion all the details.

If the file did download from Vermillion's website, it sounds like you ran into a glitch on their page & you might want to contact them & let them know, so they can fix it, as it doesn't appear that this set is intended to be a freebie. If you downloaded the set from another website - again, you might want to let Vermillion know that someone is pirating their designs -- either way, I'm sure they will appreciate it!! They do have some gorgeous designs for free download, but the Fantasy Bears isn't one of their freebies.

It was not vermillions site, it was a different one..I only went to vermillion to see if they were their designs and they were exactly the same..I got all 6 of the bear designs. I called them..

I got curious and had to visit the Vermillion web site. It was a very interesting and pleasurable. It was really neat to have the music in the background as you looked. I think you must have gotten a good deal.

the lady at Vermillion said I got about $375.00 worth of free designs..they said I could keep them but needed all the info about where I got them..I gave it to them..

Hi, lr, I'm gonna try to answer your question. A little hint: if the question is too long, put the rest of it in an answer to your own question, makes it easier to keep the information together.
About the Fantasy Bears set: first, the artwork might have been purchased by more than one digitizer. There is artwork that is exclusive, semi-exclusive (usually 6 sets sold) and clipart, any number of sets sold. Prices of course go from very expensive to inexpensive. So the same artwork could be used by many digitizers, and what one person is selling for $70 (a bit steep in my opinion, for *anything*) another could be giving away free, because maybe she is just starting a site, or just learning to digitize? That being said, there are also unscrupulous people who steal designs and give them away. Some folks just don't get that if you buy a design it's yours to sew out, but not to duplicate & give or sell. You're buying the right to USE it only, not anything else. Most just do not 'get' it, and are well meaning people trying to 'share' things with other gals. Some do 'get' it very well, and are stealing designs hoping they won't get caught. Copyright law violation is a Federal offence, carries fines and jail time. If you are sure it's exactly the same digitizing, not just the same artwork, you might want to give a heads up to the original site. But then, how do you know which one is original? Someone could be downloading freebies, and selling it as theirs for big bucks. This copyright stuff is soooo tricky, be really sure before you blow the whistle. Could you give us the 2 sites so others could compare? We have professional digitizers in this community, who could probably tell if it were same digitizing or just same artwork. Also, that $69 strikes me as odd, unless it's a well known place like Dakota, OESD, some of the big names. "Normal" digitizers just don't get those kind of prices for design sets (unless they're a whole lot smarter that me, lol). Let's check on this further, if we can. Thanks for bring it up.

I looked up the set in Vermillion, its exactly the same pictures and file numbers. They sell the disk for 29.95 on their site, the pictures are exactly the same..As far as passing it on..I dont think so..I dont want to get into any trouble so I never give away designs.

I have 3 huskvarna viking machines and all the accesories and updates worth thousands, I could loose my machines if charged with copyright violations..so I dont take any chances with software..I never pass it on even freebies.
