what i have been trying to find the answer to, is it o.k. to digitize licensed work if it is only for your own use--you won't give it to someone else and you won't sell the item you made?
No, it is not.Not licensed artwork such as Disney, Super heroes, sports logos,cartoons etc.
Even legitimate, licensed designs from reputable websites are not allowed to be sold on items you make.
I don't want to sell anything. not the design, not the art, not the item i make with it.
I simply want to make it. NOTHING, NO part is to be sold or "shared".
My question pertained to personnal use only.
No you can't. If you did not purchase the license to digitise these, you can not even do so for personal use.
Copyrighted artwork you can, but not licensed ones.
I am bringing this to the top again as I think some people still don't understand they can't put their name after "Original Artwork" if they only digitised a drawing by someone else.

I know myself am still new to sharing my lace designs. And I create every design from scratch using my embird software. That is why I put my user name in the owner box. I don't like to copy other's work but enjoy when someone try something different with my designs.

I have another question about Orginal-Arwork or copyright. If I have designed and digitized a embroidery by my self, what I must write in column? My Name?
yes, as long as YOU have drawn the artwork from your own idea, it can NOT be something you have copied.

The picture wasn't from a book. That I know. It was a picture from internet.
I am bringing this back to the top because I noticed there are still some people not putting the owner of the artwork in "Original Artwork". This means the clip art used for digitizing, not the digitized design.
We can't stress the importance of this enough!!!
If you didn't draw it, buy it, or get it as a free gift from the original artist,
in other words,
if you don't have a "Licence" to use it,
then you MUST NOT use it to digitise from to sell or share with others!!!!!
You can be sued for theft of intellectual property, breach of copyright, even both!!
And ignorance, in the eyes of the law, is NO defence.

Hello dear cuties, I'm the one who writes down 10. But also have my own pictures drawn and digitized. They always call me 10 and 10 so that's why I entered. The next time I will fill 10tje because you know me as 10tje. I understand what you mean and I can understand that. But if I sign it myself so I use my own name.

Hi, I think most of us know your super work and know that it is an original of your own creation. The post is for those who have put up work and not put who it is by as it might not be their work. Please keep sharing your great work, I love it
Hello 10tje, I know you draw the designs yourself, it is only when you use a design from a digitizing page that you have to mention the name of the artwork.
I am not sure what you mean by digitizing page, Iris, but you need to acknowledge ALL artists. And that includes the ones I have mentioned above. Not all of us were aware that 10tje drew her own, and providing she didn't copy them from another source, she is fine doing what she has been doing.

I do think there are many new members here who think the designs there are "shared" by Cuties, they don't realise they are DIGITISED by Cuties.
Perhaps Miss V should consider re-naming that section to Gifts Digitised by Cuties.
They aren't free, it costs us, sometimes, many hours work as well as the cost of the artwork so I think Freebies definitely doesn't apply.

Well said. I haven't put up any of my designs because they are either not up the the standard I would expect to buy, or the artwork is copyrighted. I so wish I could draw. I hope to eventually get good enough to digitize some of my flower photos. Then it would be my "artwork."

Thanks Ricky. I was pretty ignorant and downlaoded from "Design By Cuties" without ever checking where the art work came from. I will pay a lot more attention to that in the future.

And, just a reminder, since there are so many new people here, Designs by Cuties is a place to upload designs that YOU yourself have digitized. There seems to be a bit of confusion among some newbies, seeing all the 'thank you's' for being so generous and 'sharing' with us, that we can share designs done by other digitizers. Eeek. I know you guys work hard on your designs, and we're all grateful for your wonderful digitizing. I want to be clear to any newbies, Designs by Cuties are digitized by the Cuties, not copies of other people's work. It would be illegal to post any other digitizer's work there but your own. In order to post there, you MUST be the digitizer, and have permission to use the artwork. I hope I'm being clear, because I think a few people got the wrong impression. Or else just couldn't imagine we have all that talent among our own Cuties, which I think is pretty special! I just had a couple of questions from people wondering why nobody would 'share' Veronika's alphabet when all the people were 'sharing' in Designs by Cuties. Maybe we ought to come up with a less confusing word? This is hard enough to explain in English, let alone French, Dutch, German, Afrikaans, etc. Thanks for bearing with the explanation for the newbies, and thanks so much for all the time y'all take to digitize and upload your work!
